Rude Speeding Ticket Response Gets Driver in Big Trouble

A 22 year-old from Connecticut wrote an extremely rude message filled with profanity on a NY speeding ticket that he was issued in the Catskills. Aside from insulting the town that issued the ticket and cursing, he crossed out the name of the town, Liberty, and wrote “Tyranny” on the ticket. At the hearing, the judge chastised the driver for his foul language and overt rudeness. The driver was charged with violating New York’s aggravated harassment law, handcuffed, and arrested. Afterward, the driver was booked, fingerprinted, handcuffed to a bench and forced to pay $200 bail.

Currently, the driver has filed a suit in federal court seeking a clear determination that New York’s aggravated harassment statute is unconstitutional and that his First Amendment right to free expression was violated.

The New York Civil Liberties Union (NYCLU) is representing the driver and suing for damages due to pain, suffering, and humiliation.

According to the driver, “No one should get arrested for speech … All I did was express my frustration with a ticket and I almost ended up in jail. I want to make sure nobody else ends up in a similar situation because of this law.”

According to the statute he was charged under:

“A person is guilty of aggravated harassment in the second degree when, with intent to harass, annoy, threaten or alarm another person, he or she: … communicates with a person, anonymously or otherwise, by telephone, by telegraph, or by mail, or by transmitting or delivering any other form of written communication, in a manner likely to cause annoyance or alarm.”

Although police continue to enforce the statute, several court rulings have cast tremendous doubt on its constitutionality.

In 2003, the NYCLU won a federal court case that declared the statute unconstitutional as applied to speech that was merely annoying or alarming. The opinion of the court warned that “state and local police officers and prosecutors would be well-advised … to cease arrests and prosecutions under this section.”

Additionally, the New York Court of Appeals—the state’s highest court—ruled in 2003 that the statute cannot be applied to speech just because it is “crude and offensive.” In 1997, a federal court judge found the law to be “utterly repugnant to the First Amendment of the United States Constitution and also unconstitutional for vagueness.”

In March 22, 2013, the aggravated harassment charge against the driver was dismissed. The municipal judge presiding over the case noted that even though his words were “crude, vulgar, inappropriate and clearly intended to annoy,” the First Amendment protected his speech.

High Speeding Tickets In New York

There are some records that you might want to avoid, like getting clocked driving over 120 mph on the highway.  Recently a Washington state driver was caught riding his motorcycle at 130 mph through central Oregon.  The man was enjoying the thrill of riding his new motorcycle on the open roads in Oregon before a police officer clocked him on his radar doing 130 miles per hour in a 55 mile per hour zone. 

After being pulled over the man was honest and told the officer that he was checking to see how fast his bike can really go and if he got what he paid for.  Well it turns out that the motorcyclist might have gotten more than he paid for as the automatic fine for anyone driving over 100 miles per hour in Oregon is a whopping $1,103 fine.  In addition the bike enthusiast could also have his license suspended.

In New York traffic tickets work pretty much the same way.  The faster you go the higher the fines and penalties.  If you are traveling a mere ten miles or less over the speed limit then you are facing 3 points against your license and less than a $300 fine.  Compare that with driving 40 miles over the speed limit and you can be looking at a $600 fine, $85 surcharge and an additional $675 with the DMV Driver’s Responsibility Assessment.  Not to mention having your license suspended or possibly revoked and the judge possibly imposing up to a 15 day jail sentence.

The biggest cost factor doesn’t actually stop with the fines assessed from the court and the DMV.  Insurance premiums for high speeding tickets are pretty much guaranteed. The only way guaranteed way to get a reduction is by taking a defensive driving course that will reduce your rates a mere 10%.

Increases In The Cost Of Traffic Tickets In New York

Earlier this year the Governor of New York proposed to add a surcharge to those traffic tickets in New York.  The Governor also called for reducing the ability of prosecutors to bargain down the charges for any speeding ticket that is 20 mph over the limit.  The Governor argued that plea deals that result in a reduction to a traffic violation that do not have a surcharge cost the New York State budget close to $58 million dollars a year in lost revenue.  Many argued against the proposal including the National Motorists Association stating that it is yet another way for the government to squeeze money out of the pockets of New York drivers.  Recently lawmakers were asked to vote on the Governor’s budget proposal.

Do Woman Get Ticketed Less Often or Are they Just Better at Getting Out of Speeding Tickets?

Everyone knows the feeling of when running late for work or the experience of trying to make it to a party or gathering only to see an officer around the corner scanning your car with his radar gun.  You attempt to slow your car down, but it is too late you get pulled over.  You try to make excuses to try to appease the officer and attempt to get yourself out of a potential ticket.

A traffic ticket in New York can cost you hundreds of dollars in fines and penalties and potentially more money in increased insurance premiums.  This is especially true if you have more than one or two tickets in your driving history.  So it makes sense that fighting your ticket can save you hundreds of dollars and is the best way to go in keeping your license clear.   But did you know that you can start the fight right when the officer pulls you over?

A recent study by the PEMCO car insurance surveyed over 1000 people in the states of Washington and Oregon people were asked how often they had been pulled over by police.  66 percent of them admitted that they had been stopped more than two times and 25 percent of them stated that they had been pulled over at least four times.   This study had shown that men are getting more traffic tickets then women.

You may be thinking that there is a clear gender bias at play here but there are other factors to consider.  First some research points to the fact that women are more inclined to talk to the police officer and communicate exactly why they were driving in a particular way whereas men usually remain quiet and are upset with themselves for getting caught.  Either way there is no harm in a friendly explanation as it may go a long way in getting you out of your traffic ticket.  The only problem can be that once you are pulled over on the side of the road any information that you provide the officer can be used against you in court so you must be very careful as to what information you offer the police officer.

Police Use of Pacing to Convict for Speeding in NY

Speeding tickets are far and away the most issued traffic ticket by police officers.  Speeding tickets have been given out for decades and people driving in NY are still caught speeding by the dozens each day.  Police officers can use a variety of methods to detect how fast you are going including pacing, aircraft, radar and laser. 

Police officers are trained to use various types of equipment, their observation and other techniques such as pacing to detect how fast a driver is going.  Police officers use pacing quite often when they are not in a proper position to use a radar and can visually see that a driver is breaking the law.  Pacing is when a patrol vehicle is following your car at the same rate of speed and the officer checks their speedometer to see how fast you were going.  A police officer can use the pacing method to charge you with a speeding ticket in NY and you can be found guilty of the charges in court.

Usually the officer first will observe the vehicles on the road and if he/she suspects that you were speeding then the officer will pull out from his parked position and begin to speed up to catch your car.  The police officer is required to maintain a constant speed between the police vehicle and your vehicle long enough so that a reasonably accurate estimate of the speed can be made.

How Can I Fight My Speeding Ticket Where The Officer Paced My Car?
