If you are a Canadian driver traveling into NY, you need to be extra careful and understand that you may be in more trouble than you originally thought if you receive a NY traffic ticket.

New York State will transfer notices of conviction to Ontario and Quebec provinces and they will assess demerit points against your Canadian driving record.

Canada Has Reciprocity With New York

Although the United States and Canada operate under different laws and legal systems, both countries share driver information with one another.

This information includes who receives a traffic ticket as well as when and where. In other words, Canada has reciprocity with New York (and vice versa).

How Demerit Points Work in Quebec

The Société de l’assurance automobile du Quebec (SAAQ) made it abundantly clear that an equivalent offense committed in another province or in an American state that Quebec has a reciprocal agreement with (e.g. NY) will result in demerit points being put on your driving record as if the offense occurred in Quebec itself.

Put simply, if you received a New York traffic ticket for an offense that is recognized in Quebec, then you will likely receive demerit points on your Canadian driver’s license. The points you receive will be set by the SAAQ point system based on the equivalent offense that you committed. Remember, you will only be allowed to receive a maximum of 15 demerit points on your license.

If you receive more than 15, you will lose your driving privileges for a set duration of time (usually 30 days) and your license could be taken away (depending on the offense you commit).

Remember, Ontario also has reciprocity with New York. According to the Ontario Ministry of Transportation, demerit points will be assessed against you for any traffic violation that you commit in NY that is equivalent to a traffic offense in Ontario.

What are the Ramifications of Speeding in NY With a Canadian License?

If you received a NY speeding ticket, the number of demerit points that Quebec will put on your license directly depends on the speed you were going and how many miles over the posted speed limit you were traveling.

For instance, if you received a speeding ticket for driving 80 miles per hour in a 65 mile per hour zone (i.e. exceeding the limit by 24 kilometers per hour), you would receive 2 demerit points. If you received a speeding ticket for going 90 miles per hour in a 55 mile per hour zone (i.e. exceeding the limit by 56 kilometers per hour), you would receive 10 demerit points.

It is crucial to note that Quebec does not assess demerit points for only traveling 10 kilometers per hour or less over the posted speed limit. In other words, if you hire an experienced traffic ticket attorney who is able to get your traffic violation reduced to a ticket for simply going 6 miles per hour over the posted speed limit, Quebec will not assess any demerit points against you.

However, in Ontario, speeding tickets tend to range from 3 to 6 demerit points.

  • More specifically, if you exceed the speed limit by 16-29 kilometers per hour, you will receive 3 demerit points.
  • If you exceed the speed limit by 30-49 kilometers, you will receive 4 demerit points.
  • If you are caught going 50 kilometers or more, then you will receive 6 demerit points.
  • Lastly, Ontario does not assess demerit points for speeding 15 kilometers or less over the posted speed limit.

Therefore, if you hire a traffic ticket attorney who is able to get your ticket reduced to one for traveling 9 miles per hour or less over the posted speed limit, you will not have to worry about having demerit points assessed against you.

Penalties Associated With Demerits

If you are a new driver and get 2 or more demerit points, you will be sent a warning letter. If you get 6 points, you may need to provide a good explanation for why you should be allowed to keep your license. At 9 points, your license will be suspended for 60 days.

If you are a fully licensed driver and receive 6 demerit points, you will be sent a warning letter. Once you obtain 9, you could be compelled to explain why you should be allowed to keep your license. However, if you receive 15 points, your license will be suspended for 30 days.

Aside from the possibility of having your license suspended or revoked, receiving demerits will cause your insurance to skyrocket. You can also incur hefty fines. After I returned to Ontario, I contacted the court clerk and then the prosecutor, by email, with a letter requesting more information on the charge and proceedings, since the ticket did not contain any information about the expected fine/demerit points or the process for how to defend the charge. The prosecutor told me he would be sending a letter by mail, however as of today I have not received the letter, and the original set court date has passed. I would like to know what is my liability, given the missed date?

    I received two tickets last month while i was on a camping trip to Cranberry Park , Tupper Lake County. One for Over speeding (has to overtake 3 slow moving vehicles which were moving at 40 MPH in a 55 MPH zone for like 15 miles). Second for interfered without safe operation. I pleaded guilty via mail since it was too far for me to go to the court on the date of hearing. As a response the Tupper Lake Court fined me 311 $ which i already paid via money order.

    On last Friday 21st Octi received another notice from New York State Department of Motor Vehicles with Driver Responsibility Assessment Statement asking me to pay additional 525 $ with the court location as Altamont. Can you please suggest if i need to pay this amount? I feel that i’m being cheated now and these guys are asking un-necessary money and that too for no reason. I tried calling the DMV office and they asked me to make the payment indicating this as a separate payment.

    1. Pawan – The rule in New York states whenever a driver receives 6 points or more on their record, the DMV charges a Driver Assessment Surcharge fee. Since you have already plead guilty to these violations, you are required to pay the amount requested to the DMV.

He did not show me the radar but I’m assuming this as on the ticket it shows it. What is me best option. I don’t mind the ticket being paid, however, I dont want to have demerit points on my record. Hello, NC driver was issued 2 tickets on I-84; one for failing to use turn signal to change lanes to let someone pass, and other for driving unregistered vehicle due to failed NC safety inspection for lost muffler which keeps you from registering vehicle.     1. This violation would not result in the loss of any demerit points. Further, Mount Morris Village Court does not provide reductions on ‘disobey traffic control device’ violations if the original charge was for speeding.

    The court that I’m assigned to is the North Dansville Town Court.

    I pleaded not guilty by mail and they sent me a reply for a pretrial conference or to negotiate an alternative disposition with the Livingston County District Attorney by mail.

  18. Hello, I just received a NY State speeding ticket for 61 mph in a 40 mph zone. i was coming to the Ivy Lea bridge authority where the zone changes form 65 to 55 to 40 in about a km. The ticket says the officer was operating laser 1372 feet north of second posted 40 mph sign feet from the second set of 40 mph speed zone signs and I was travelling 61 mph 529 feet south of patrol.

    I got speed ticket on I87 for doing 86 in zone of 65 even the patrol said was 85 but after I realised he wrote 86. court is Cornwall town NY and i live in Montreal.

    Also official wrote my address without apartment number and license class UNAVL but in reality it is class 5.
    I was 8 august, I was evaluating my options but unfortunately I realised today that limit date to answer was first September 2016.

    Our family was in Niagara Falls NY last Monday. We are from Ontario. I was driving on the I-190 North about half a mile from the Queenston-Lewiston bridge where we were going to cross back to Ontario. There was a state trooper that we noticed on the island in the middle. There was a car in front of us (a blue Toyota Venza) that was doing the same speed as us…I know because I was following him; same speed. We both passed the trooper. The Toyota got off at the last exit before the bridge – NY plate, and I stayed on the highway. The trooper pulled me over. I asked why she did not pull over the car in front of me as we were both doing the same speed…yes 60 in a 45 zone. She said I caught up to the that other car. I don’t know how she saw that if she was behind me and the other car got off the highway.
    I really think that she picked us because we were from Ontario and easier to give us a ticket.
    Should I pay it and be done with it, or fight it somehow. Ultimately we were speeding but not by much. Also, how many Ontario demerit points would I get for this offense; I have none previously.

    1. Cynthia – you raise some interesting points that we do hear on a regular basis. a) Going the same speed as another car is not a defense to speeding. A judge will simply say that the officer was not able to ticket multiple cars. B) – While you might have been targeted based on your out of state plates, that does not negate any speeding ticket.

      This is a 4 point ticket, and 3 demerit points will be assessed against your ON license. The fine for this offense is approximately $393.

    I was in NYS recently and received a ticket for speeding 65/87 mph. As well as not pulling over for a police car with flashing lights.
    I pleaded guilty and received a 2 fines speeding, at $190 with a surcharge at $93.00 and the other fine at $100.00 with a surcharge of $93.00. It was also noted that I was getting another bill from NYS DMS.
    Can I get these fines reduced? What are my options?

    1. Surcharges are fees added onto the ticket fine. Assessment charges are imposed if you receive 6+ points on your NY license. It will be nearly impossible to have these fines reduced after you have already plead guilty to the offenses. There are, however, avenues to withdraw your already entered guilty plea.

GOOD MORNING, driving back to canada on a toll stop on the I-87 (woodbury) an agent was standing at the toll booth. while i got the toll ticket ( and was expecting to have to pay right away since it was first time driving through) i released my seat belt to reach for my wallet. before i could go through the booth and right after i recieved the toll ticket, the agent came to me asking why i wasnt wearing my seat belt and asked me to pull over and gave a=me a fine for no seatbelt. even if i told the agent i was just reaching out for my wallet he didnt care and gave me the ticket. this was on May 26th of this year.

    So i am an ontario resident and i received a speeding ticket for going 79 mph in a 65 mph highway in (14mph over) in New York State. From what i read on your website, i would not get any points deducted from my ontario driver licence, is that correct?

I received 2 speeding tickets in 2015 (no demerit points) and i belive that most insurance companies especially in Ontario usually hike up your rates if they see numerous speeding tickets (even without points deducted). The motorcyclist kept coming up right behind me, causing me to change into the left lane.     I received a speeding ticket in a work zone. Section 1180F. There were 4 vehicles traveling at close proximity, first 2 passed by ok, I was the 3rd and another vehicle behind me. Unfortunately the last 2 both got pulled over. Ticket was 68mph in a 50mph zone, normally it’s 65mph but since it was a work zone, it drop down to 50mph…but if I were to significantly reduced my speed instantly at that moment …I believed that there could have been an accident that would have occurred because road was starting to reduced to one lane only with the cones in placed and the SUV in back of me was at a close distance to my vehicle…while traveling within the section of the cones, I was sure that I was within speed limit.

  101. Hi Adam, I received speeding ticket last week while returning back to Toronto at Steuben county/Wayland Town. It was 65mph zone and I got the ticket for 81mph. It was down hill and car got speed up which I explained cop but still the ticket has been issued with same reason in the ticket.
    Office asked me to mail the ticket to Wayland court mentioning if I am guilty or not. Can I fight this case? If so, do I need to be in person to Wayland court? Please suggest.

    Police officer suggest me to make a request for “reduce traffic infraction” since i will a lot of troubles with this kind of speeding. The fine is not the thing i’m worrying about; points and possible driver license suspension here in Quebec as well as across NY state.

    I was recently driving through New York state on the I81 heading north back home to Canada when I got pulled over for going 70 in a 55. I had been driving for 11+ hours (which I did not have a chance to mention to the officer) and was so exhausted I hadn’t realized how fast I was going. It was 10:11pm and the report says that the officer directly witnessed the incident and verified it using a Stalker Dual Radar. I was wondering if there was anything that can be done about this seeing as I cannot make a long trip down to New York state for the court hearing.

  105. I was going back home from Syracuse to Ontario, and got caught in Alexandria Bay on Highway going 80mph in a 55mph zone, just prior entering in the 40mph zone VTL 1180B . Told him that I was sure that it was 65mph and was doing max 120 km/h. He gave me a tickets and told me that I could go to court or plead guilty. On my return since I had only 48 hours, return the ticket not Guilty. The town of Alezandia Justice sent me a court date for nes=xt week and told me that I should contact them if I do not receive something 3 days prior court apperance from District Attorney. I never requested a reduction and an offer of plea bargain came to the mail . Instead of VTL 1180B I have now a VTL 1175. What should I do and what is the cost of VTL 1175 compare to 1180B..

    1. VTL 1175 is a non-speeding ticket, whereas 1180B is. I suggest you contact your motor vehicle department to determine how many points, if any, will transfer over from these violations. The points, not the fine, is the most important issue here.

I had an infection so when I need to pee it really hurts and I can’t wait much I was feeling like I was going to pee on myself.     1. I strongly suggest you fight this ticket, as it carries significant fines and penalties. While you will not be able to do community service in lieu of paying the fine, there are ways to substantially reduce your penalties.

    A few years ago, close to 2011, I got a traffic violation in NY. It was, if I remember correctly, going through a toll both with another rider. I was on my motorcycle at the time. I tagged behind my buddy who had transponder for NY but I was stop as I was going through.

    I remember getting some letters saying I had to pay a fine (can’t remember what it was or amount). I didn’t pay the fine. Then I recall getting a letter saying I’m not allowed to drive in the state of NY or something of that sort.

    In July, I have a company convention I have to attend in Atlanta. I want to know if I we drive down to the border, will I be detained or arrested for that traffic ticket? It was so long ago I don’t really remember the exact charge. Can you please help me?

I was in a rental, very tired, past two cars doing radar then a third cop caught me going 102 mph on a 65mph on the shoulder (I believe I-81) in Cortland NY I’m 26, g2 license never got a speeding ticket and never crossed the border in a vehicle What should I do?     I just received a speeding ticket in upstate new york between Syracuse and Watertown. I was changing lanes as there was a large van in front of me and then I the state trooper reached and later pulled me over. He asked me why I thought I was being pulled over and I responded that I was drive a little of the speed limit. My calculation was I was going between 70-75mph and the trooper mentioned his radar was 78mph. On the ticket he estimated I was traveling 80mph. He didn’t provide a warning and gave me a ticket. He mentioned that since I was in Canada I can mail in my plea. However, after reading my ticket, the only option was a guilty plea if I decided to mail my ticket. My court date is in a few weeks but I will be traveling. Can I request an adjournment? Are there cases where my ticket will be dismissed? I didn’t realize my personal information is being exchanged and may affect my Ontario record if found guilty. I was willing to pay but there is uncertainty that the troopers radar was on the van and not my car and my first name on my ticket is incorrect. My main concern is the demerits. My court time is at 7am, so I’m not sure if that was done to deter me from going to court. Your assistance is much appreciated.

  116. On my way back to Ontario, got a VTL 1144-aa (failure to take due care for stopped or standing emerg vehicle). Driving on IS91, two lanes, I did slow down , couldn’t change lanes but obviously, the officer didn’t think so. I pleaded not guilty.
    I wrote the ADA and got a response indicating that it is not the office protocol to reduce this type violation – provided a fine (~ $130) with 2 points.
    I assume the points and conviction will impact my insurance over in Ontario.

    Is there a point fighting this further? Can an attorney do any better in this circumstance?

    Was going 80/mph in a 65/mph zone around 2 am in NY state, no cars around, and I was in plain sight. Got pulled over and tried to get out of it by admitting I was going “about 120 km” hoping she would let us off with a warning. This was captured on my ticket. I understand that this is 3 demerits in Ontario as it would fall within the 16-29 kmph range, but would I be able to get it reduced to 15 km over and avoid the demerits? My admission of 120 km is about 15km over the 105 (ish) speed limit.

  120. i was driving north on I-95 around the end of janurary of this year 2015 i was at a 50mph zone around 2:20am i was pulled over in the bronx on I-95 but here is the issue at the time i was traveling in the passing lane with 20 plus cars traveling 75-90 in the middle and right lanes traveling passed me. the cars in the middle and right lanes braked so did i because i seen the cop i was traveling around 55 and braked to 45 as i was driving in the left passing lane the cop that was parked on the right side of the road drove up towards the car that was speeding in the middle lane then but he hesitated and went to me where i was in the left lane and pulled me over when he approached my car he said 75 just like 75 im fighting this ticket because i was not the one speeding everyone else was passing me my court date is May 15 2015

    I was travelling back from NYC to Toronto when I was pulled over for speeding. The office simply stated that he has me at 76 in a 55 zone, and asked for my license. He would not let me say a word edgewise or answer any questions, but just asked for my license. Then he simply took my license, came back with a ticket, and without so much as any explanation, just walked away. It was moderate traffic on Friday evening, so I am sure I was not so much over the speed limit (in fact keeping with the flow), especially with my two young sons in tow. But the officer just refused to explain anything. I am not sure what my options are, and I certainly cannot afford expensive penalties. What do I do? Help.

    I am from Ontario and last year in August I was caught speeding on a highway in New York State. The police officer issued me speeding ticket stating I was driving 88mph in 65mph zone. I was driving over the limit but never more than 82mph. I never pleaded guilty/not guilty.
    In January I received a Notice of Failure to Comply which states that if the court does not get my response by Feb. 5th, they will suspend my right to drive in NY and will also ask my province to suspend my driving license until I respond to this notice.
    I called the court named Town of Brutus located in Weedsport, NY. A lady told me I need to send them my plea and that if I decide to plead not guilty they will send me an address of DA (who is currently 10 weeks behind) and who may be able to help me reduce my demerit points but not the fine. (?!) She said that the fine rangers from $0-$600 depending on a judge’s ruling and that there will be some additional charges. How much demerit points I am looking at here and how much may be the ticket fine and those additional charges? Thank you!

  129. I had been arrested in 2007 on the highway, and the policeman give me a ticket for a crack in my window, at hudson town. On the ticket it had no fine on it. Here in Quebec province, when the pocie arrest you for a window crack or a burning light, it’s only to give you an advise that you have 48 hours to repair your car or after that, if the police get you unrepaired, he will give you a fine. So I did not do anything with this ticket believing it was an advice with no fine. the time had past since then, and i never received anything by mail since my ticket was deliver. Last week, i received a letter from the SAAQ telling me that i have a ticket not cleared and i’m not allowed to drive in the New-York state or i will pay fine and maybe go to jail. I call many place at SAAQ and no one know what is the problem with the new-york state. My file is clear and i have all my point and it’s not write in my file that offense. I call the New-york state driving place and they tell me that i have to send a letter for pleading guilty or not. What i have do, and can i explain why i did not respond to the ticket if a plead guilty. And i much it will cost me?

  133. On Jan 23 rd I recieved a ticket for passed red signal. There was no amount. When I asked the officer replied that it depends on the number of offensives I have tbe max being 250.00. I advised that I don’t have any how much is the minimum. He replied 50.00. He failed to tell me that there are 3 point as well. Is this correct as this is what the court told me when I called.     I have a clean driving record and any points I will get if convicted will expire by June 2015 so at this point I am only trying to understand in the financial pros and cons of retaining representation vs just paying the ticket.

The fine is approximately $300.00 – along with the impact on your insurance. Hiring at attorney will allow you to protect your rights and assure the best outcome is obtained in your case.

    I received a deposition on Dec 23/14 travelling on 81 to NJ from Toronto. Apparently 81 in a 65 zone. I most guarantee I wasn’t driving that fast. I was 2 car lengths behind a trunk in the right lane. Why did I get the ticket and not the truck if we were supposedly traveling at 81.
    I didn’t realize this was an actual ticket because there was no fine stated and the trooper didn’t exactly explain the procedure. And I have never recieved a ticket in the US.
    Apparently I am suppose to appear in court on Monday Jan 26 and I can’t make it.
    Please help.

    1. Anthony – it appears you are referring to the ‘return date,’ which is not the date of your court appearance. If you are interested, it is still possible to fight this ticket and avoid the penalties.

  136. I have been trying to get an answer on translation of michigan traffic violations to ontario. I realize this web site is for New York but since both Michigan and New York have reciprocal agreements with Ontario, I thought I would ask anyway. I have pleaded not guilty to a careless driving charge and the prosecutor is offering me a reduced violation of speeding 1 to 5 mph OR violation of basic speed law. I wondered which one has less chance of abstracting to Ontario or would be seen in Ontario as a lesser violation.

    The ticket was issued on Jan.2.2015 and the due date to respond is Jan.15.2015 @7pm which is 13 days….even if the officer wrote this date, can I still go buy the 15 days minimum standard?

    Because it doesn’t seem like my mail will reach there in time.

    I live in Toronto and after so many years of driving I got my first lame ticket in NY for “FLD DUE CARE FOR EMERG VEH STOPPED OR STANDING” in Richland, NY on Jan.2.2015 and the officer told me I had 30 days to respond by mail, however, I just realized that the date to appear in person or return by mail is Jan.15.2015 at 7pm (tomorrow!). I also just realized that it says in very small print that I only had 48hrs to plead not guilty…

    I have a few questions:
    1. Will I get any demerit points for this? If so, how much? Will it show right away on my record?
    2. Can I still plead not guilty if I go to court tomorrow? Or send the mail to them express??
    3. Are there any hidden fines down the road that I will have to pay if I plead guilty?
    4. What happens if they receive the ticket response after the deadline Jan.15.2015?? Will I be further penalized?!

    Now I’m so worried that I may be even penalized further for responding late, so please help asap!!

    1. 1. You will likely not receive demerit points for htis offense. 2. You can still plead guilty at court. 3. There are no hidden fines other than the cost of the ticket and court processing fees. (There is a DRA assessment which applies for 6 points or more). 4) The court might assess late fees, although that is not certain.

  141. Got speeding ticket under New York State-Department of Motor Vehicle on my way back to Toronto on Route 86. Going 85mph in zone 65mph. I was not speeding and did not argue with office although i was going just with the flow of traffic and there were two cars ahead of me going with the same speed. I was maintaining 75mph and have no idea how it went up to 85mph for a while. I have no demerit point before however have 2 minor speeding tickets in Canada. Would USA consider them when charging fine. please advice best course to adopt as i know i was pretty careful and there was no intention for speeding, was driving first time in US. Thanks

    I’m a Canadian residing in Montreal and I just received a speeding ticket belong to ElizabethTown Court, Essex, New York. I was advised by the officer that I was driving 83 miles/hour in a 65 zone. we were 2 families and throughout the trip I respect limites. it’s the first time. On the hill I was breaking slowly down. The patrol was at my left side. I would like your advice as to what would be the next step for me? If I plead guilty, what would be the fine I’m required to pay? And how do I go about paying it?
